i'll provide a new log tonight. Since I did a clean install of XBMC i'll need to create a new advancedsettings real quick. The default log was the same as my initial post and I assume this will be the same as the second pastebin I posted in the thread. But I'll post again once I have a debug log

I doubt it's failing in CSettings::Load() as there's no info (LOGINFO won't be output by default) in there that would be output, and extremely unlikely to be a crash there given the code.
IMO it's must more likely to be in CreateNewWindow().

Given that it's easy, I would try the "NVIDIA fix" exe to see what happens.
If that still crashes the only option would be for me to build you a custom version of XBMC.exe (like the "NVIDIA fix" exe) with extra logging so we can pin down exactly where XBMC is crashing. From the log I can identify the rough area the crash is happening, but the logging needs to be more finely grained to pin down the exact line.

JR thanks for your help. I used the "nvidia fix" and it appears to be working. I'm at least in the program now I haven't tested much.
Should I create a fill out a bug report or anything?

XBMC isn't supported in a remote desktop session, though actually it will often work. Log on interactively and in System settings, System, Video output try enabling "Use a fullscreen window rather than true fullscreen" and this might allow XBMC to run in RDP. Note that this setting will slow video rendering and you might notice tearing, though this depends on your hardware.
