How to follow wiki install precise on ATV1

I may be crazy, however, why can't I follow the guide on the wiki to install Precise Ubuntu on to my ATV1?
Will it not work?

If you want HDMI audio, you need an older Ubuntu image (with corresponding nVidia binary blob and supported kernel).

are you sure? wasn't this fixed with the latest nvidia driver builds

it was resolved early this year once I nagged an nVidia contact to look at the problem and davilla loaned them a box for testing with.. all nVidia builds since 28 March support HDMI audio
