As I understand it you pointed to an android device which you say has a kernel modified to do some airplay thing that might be helpful to this project?
If so the kernel source must be available because the GPL2 mandates it to be so.
So no, I am far from joking, and copyright breach is far from a joke. Your XBMC is open source so relies heavily on copyright licensing rules for it's existence.
