Hi all, purchased the Ouya for my partner on the sole basis it was going to have XBMC out of the box but I haven't heard if this is the case (not his birthday for 2 more weeks so I can't check), does the commercial release have it?

No... Not yet. That said, you can install it manually via a process known as "side loading"
As of now you can use the stable 12.2 android release... Or for HD you can try the alpha releases of the *libstagefright build.
