We have no problem what you or anyone does with XBMC - use it to watch all the pirated material you wish, if you wish to do so, whether streamed or pre-downloaded - it's completely on your conscious. XBMC will take no steps to attempt to limit what you can do with XBMC. It's free and open for you to use as you wish.
What we do have a problem with is forum users actively promoting and linking to pirated material on this website. Further, some users here have been attempting to profit from this behaviour. Most would agree that this is overstepping the bounds of what should happen on a community forum for XBMC.
The tricky thing is it's not always completely obvious what is OK and what is not. There will always be a grey area, not least because it's quite simple for an add-on or streaming website to provide superficial access to completely legal content while the rest of the add-on or website is completely focused on not-so-legal content.
In those cases we need to make a judgement call as to what goes and what doesn't. No doubt we'll frequently get this wrong in the minds of some users by being too stringent, and wrong in the minds of others for being too lax. We'll never get it right all the time.
In the past, we've tried to do this based on removing things that are obviously violating. However, a small subset of users (and it is only a small subset) have been taking advantage of this via PM and the like. Thus, we're trying a different approach: If we have any doubt, threads will be closed. You're welcome to query each decision, but the onus is on the original poster to show it's OK, rather than on us to show that it's not. If you can make a reasonable argument, then all good.
This may fail dismally, or may work better, or may make no difference whatsoever - time will tell
