Same here. Isn't solved in 13.2 rc1. Also tried Ned Scott tip.
Looks like:
1. ATV2 => XMBC does not have write access to movie directory (afp://path-to-movies/<actual-movie>/...) where it wants to put the subtitle
or:
2. It takes to long for XBMC to connect to afp://path-to-movies/... I noticed when I change the "subtitle storage location" via:
system => settings => video => subtitles => custom subtile folder
it takes a couple of minutes before XBMC actually connects to the afp:// that I select. For about 2 minutes XBMC becomes unresponsive.
What if the same happens when you actually download the subtitle? XBMC trying to setup a new connection to afp:// that times out?

When I use afp://path-to-movies/ as custom subtitle folder the subtitle is actually downloaded to that directory. However, movie (or tv show) will crash after download when it starts playing.
When I use the "Next to video" option (default) the subtitle is not downloaded at all.

Found the problem. In my case the atv2 user only had read/write access to afp://path-to-movies/ and
not to afp://path-to-movies/<actual-movie>/... Had to change the share settings to include sub folders and I'm now able to download subtitles to afp://path-to-movies/<actual-movie>/ and play movies & tv shows. :-)
About a month ago I migrated all my data from MackBook Old to MackBook New. Guess something went wrong with my shares during that process....
