My bad, it's what popped up when I searched for Kodi Forum user agreement, is there any sort of user agreement that would put restrictions on the copyright claims of posts?? I don't remember if there was when I signed up on the forum. Under US law (sorry don't know much international law) there is an automatic copyright of any content created by said individual so long as it is unique or not a derivative work (etc.) however I am not sure how that would apply to an online forum. I would imagine it would fall under public domain as it could be argued as public speaking but I am not a lawyer so I can't say for sure. But either way the site is still in violation of the Kodi trademark.

As far as I know, the content of messages posted to the forum are basically owned by the poster. Of course, posting them on our forum is also granting the Kodi project permission to display the messages on our website, because that's what the poster is trying to do :)

However, I'm not a lawyer and it's very possible that I am completely and entirely wrong about that.

I think if it were ever tested in court even without a user agreement posting a message on a public forum is basically giving up any rights or ownership most of the time. I mean I know before I hit 'Post Reply' that this post can be deleted, moved, edited, and quoted all without my permission. I do think that XMBC has enforceable rights over the forum and the posts because no one can argue that copying the entire board for monetary gain is "fair use." Too bad it is in China.

I think the exception would be posts directly intended to be works of art. Where is the Kodi Haiku thread anyway?

So I asked my Computer Ethics and Law professor who used to be a lawyer dealing with copyright and she said so long as the post is original enough it is automatically copyrighted (think long how-tos or personal opinion). Now because of the nature of web forums it is assumed that most use cases fall under fair use (sharing, coping, quoting, etc.), however since he is monetizing with added ads he can not claim fair use as it is a direct profit from the content on the forum. So everyone send you cease and desist orders you all have claims Smile
