[LIVE] suspend only works once

I have a Giada N3 and running XBMC live. My problem is when I suspend it, the first time it works fine, goes to sleep, and I even got wake on lan working to turn it back on. But if I try to suspend it a second time it doesn't work. More specifically it goes to a black screen with a flashing cursor on the top left corner for about 10 seconds and then comes back into XBMC. If I reboot it, it all works fine. I get one suspend, then the flashing cursor. Any thoughts on this? Thanks.

This is XBMC live 9.11

The N3 has an Atom and the Nvidia Ion chipset.

I set it to S3 (STR) in the bios ACPI settings.

S3 Video repost is disabled

APM is enabled along with wake on lan.
