In a movie I untick subtiles and save as default
guisettings.xml has this: <showsubtitles>false</showsubtitles>
Yet I get subtiles every time I start a movie
Using 12R3 on a Asrock ION330 with the confluence skin

That's probably because the subtitles are part or file or enabled inside the file.

The link its so you can post proper information to begin with
You give no OS post no debug logs etc, and leaves ppl trying to help making guesses, even if the guesses happen to be right.
Anyway you can use mkv merge gui to disable the subs setting the flag from default or enabled to no
XBMC cannot disabled those sorts of subtitles you have to remux the streams.
